2. Limitation of Liability
As a condition of our providing the information on this site, the viewer agrees that CE Solutions is not liable for any indirect, special, incidental, consequential, or punitive damages, or any other damages, including damages for loss of business, loss of profits, or litigation costs, whether based on product liability, tort (including negligence), or any other legal theory, even if CE Solutions has been advised of the possibility of such damages.
Under no circumstances, including negligence, shall CE Solutions, its officers, directors, agents, employees, contractors, or anyone else involved in creating, producing, or distributing this site be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or the inability to use this site, or that result from mistakes, omissions, interruptions, deletion or loss of files or data, errors, defects, delays in operation or performance, acts of God, communication failure, theft, destruction, or unauthorized access to our records, programs, or services.
All responsibility and liability for any damages caused by viruses contained within the electronic files of this site is disclaimed.
3. Accreditation
CE Solutions is accredited by the Texas Department of State Health Services, CE Provider number 101129, and the California Emergency Medical Services Authority, provider number 94-4601. CE Solutions (ems-ce.com) is also accredited by the Commission on Accreditation for Prehospital Continuing Education (CAPCE), is an NREMT accepted provider, and is accredited by the Texas Commission on Fire Protection (TCFP).
Our program has been accredited and re-accredited by these agencies since 1997, and we fully expect the program to be re-accredited in the future. However, we cannot guarantee that the program will remain accredited by any agency at any time. In addition, we cannot guarantee that any state in which our program is currently accepted will not change regulations or policies in a way that affects our acceptance by that or any other agency.
CE Solutions does not assume any liability for courses taken that are not accepted by your regulatory agency. It is your responsibility to ensure that the continuing education courses you select are accepted by your agency.
4. Member Waiver
The member agrees to participate in this medical continuing education program with full knowledge and awareness that they waive any claim they may have against CE Solutions arising from reliance on any information presented in this program. In addition, the attendee waives any claim they may have against CE Solutions for injury or other damage that may result in any way from their participation in this program, or from the non-acceptance of this continuing education program by their regulatory department or agency. We would not provide this site and this information without such limitations.
5. Intellectual Property and Third Party Links
All text, graphics, audio, video, design, software, and other works on this site are the copyrighted works of CE Solutions unless otherwise indicated. All rights reserved. Any redistribution or reproduction of any materials contained herein is strictly prohibited.
This site may contain links to other Internet sites. Such links are not endorsements of any products or services on those sites, and no information on any linked site has been endorsed or approved by CE Solutions.
6. Governing Law and Venue
Any disputes arising in connection with this site or the information contained herein shall be governed by the laws of the State of Texas. All proceedings arising out of or in connection with these Terms shall be brought solely in Burnet County, Texas.
Failure to pay for courses and certificates obtained will be reported to your state agency as fraudulent.
7. Refund Policy
Should you find a product you have received from us unsatisfactory, we expect you to be able to tell us why. We will refund your payment provided that you have not accessed more than one course, received any continuing education certificates, have not attempted any exams, have earned no CEU hours.
In all cases where a refund is offered, we reserve the right to assess an administrative charge of ten percent (10%) to cover the expense of processing your order and refund. All convenience fees assessed at the time of purchase are final and non-refundable, regardless of whether the underlying transaction is canceled, refunded, or otherwise disputed.
No refunds will be issued after seven (7) days. If you do not meet the requirements above, a refund will not be available.
Once a certificate has been issued, it is automatically reported to CAPCE, the state, and the NREMT, and the associated reporting fees are incurred. Certificates cannot be voided, and these fees are non-refundable, regardless of whether you choose to report or apply the credits toward your recertification. Regardless of your circumstances, you will not be entitled to a refund if certificates have been issued or if the terms and conditions of our site have been violated.
A refund request form must be completed and received in accordance with the terms above. Visit https://www.ems-ce.com/refund-request/
8. Payment by Check
If an order is placed with the intent to pay by check, and CE Solutions grants course access or issues course credits before receiving payment, the purchaser accepts full financial responsibility for any credits accessed or used.
Once any part of a course is utilized, including accessing course content, completing exams, or earning CEU hours, payment is required in full, even if the purchaser later decides to discontinue using CE Solutions' services.
9. Department Orders
CE Solutions accepts purchase orders (POs) with established credit and credit card payments from departments. Payment is due net 30 days from the date of invoice. Departments with an approved credit account may submit a valid purchase order in place of upfront payment. All purchase orders must reference the applicable invoice or quote number and include an authorized signature. CE Solutions reserves the right to verify credit standing before accepting a new purchase order.
Departments may also pay by credit card at the time of order or upon receipt of invoice. Credit card payments incur a convenience fee of 3.99% of the total transaction amount.
Accounts not paid in full within 45 days of the invoice date are considered delinquent. A late charge of 10% of the outstanding balance may be applied to delinquent accounts. Continued non-payment may result in suspension of future order privileges pending resolution of the outstanding balance. CE Solutions reserves the right to review, adjust, or revoke established credit terms at any time based on a department's payment history.
10. Chargebacks and Credit Card Disputes
Chargebacks and Credit Card Disputes are rare, but they do occur. The most common reason for a chargeback is that the cardholder does not recognize the charge on their credit card statement.
If you dispute charges via the chargeback method for reasons other than fraud, you will be assessed a chargeback/dispute fee of thirty-five dollars ($35), and your account will not be reactivated until this fee is paid. Merchant accounts carry mandatory chargeback fees that are charged whenever there is a chargeback claim, valid or not. In addition, when a customer files a chargeback, penalties are also assessed. These fees and penalties are passed on to the consumer filing the non-fraudulent chargeback.
11. System Availability and Technical Interruptions
CE Solutions endeavors to maintain continuous, reliable, and secure access to its online learning management systems, course materials, testing platforms, and certification services. Notwithstanding these efforts, users acknowledge that technical interruptions or failures may occur due to circumstances beyond the control of CE Solutions, including but not limited to internet outages, server downtime, software malfunctions, data transmission errors, third-party service disruptions, or other unforeseen or comparable technological issues that may impede access or performance. This includes, without limitation, any failure, delay, or degradation of performance resulting from factors inherent to the nature of electronic communications and internet-based services.
By accessing or using any CE Solutions platform or service, the user expressly agrees to the following:
- CE Solutions does not warrant or represent that its systems, websites, or digital resources will operate without interruption, error, or delay at all times.
- Users are solely responsible for maintaining the hardware, software, and internet connectivity necessary to access, complete, and submit course materials.
- CE Solutions shall not be held liable for any loss, delay, damage, data corruption, or inconvenience arising from system downtime, scheduled maintenance, server malfunctions, software defects, or network failures, whether caused by CE Solutions, a third-party provider, or any other external factor.
- Temporary or extended interruptions in access to CE Solutions platforms shall not constitute grounds for refund, credit, extension, or compensation of any kind, unless expressly required by law.
- To the fullest extent permitted under applicable law, CE Solutions, its officers, directors, affiliates, employees, and contractors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to any technological, software, or communication failure.
CE Solutions is not responsible or liable for any issues arising from your personal technology or device failing to function properly with our system timers, video playback, or other course functionality. For best results, users must follow all on-screen instructions provided during the course experience. We recommend using Google Chrome when accessing our learning management system. If you do not follow these instructions, your system timer may not function correctly, and CE Solutions will not be liable for any loss of course time, progress, or certification eligibility resulting from user-side technical issues.
12. Reporting to CAPCE, State Agencies, and the NREMT
Once a certificate of completion is issued, it is immediately reported to CAPCE, the respective state agency, and the National Registry of Emergency Medical Technicians (NREMT). Fees and reporting obligations are automatically incurred at that time.
CE Solutions is not responsible for delays, failures, or duplicate submissions resulting from technical errors occurring within CAPCE, state, or NREMT systems. Such occurrences do not alter completion status or refund eligibility under these Terms.
13. Student Account Accuracy and Reporting Responsibility
Students are solely responsible for maintaining accurate and up-to-date account information, including legal name, certification details, and demographic data. CE Solutions requires all students to review and update their account information at least every six (6) months.
CE Solutions is not responsible for errors, delays, or reporting issues resulting from technology or from inaccurate, incomplete, or outdated student information. Accurate information is required for our system to process and submit continuing education records.
Continuing education reporting is provided as a courtesy and is contingent upon the accuracy of information supplied by the student, as well as the proper functioning of all applicable technology systems. In the event of an error or failed submission, the student remains solely responsible for reporting their continuing education credits to the appropriate certifying or licensing authority.
14. External History and Data Retention
External History is a convenience feature offered to active members. It is not a document storage, archival, or record custody service. CE Solutions does not act as a repository, backup service, or system of record for content you upload, and you should not rely on it as your only copy of any file.
Upon the expiration, cancellation, or termination of your account, access to External History will be discontinued. You will no longer have the ability to access, retrieve, or download any external history files, records, or data previously maintained in our storage systems. It is your sole responsibility to export, back up, or otherwise preserve any content you wish to retain prior to your account's expiration date.
CE Solutions reserves the right to impose limits on file size, file count, file type, or total storage, and to remove content that is unrelated to continuing education recordkeeping or that indicates use of the feature primarily as general file storage.
This section applies only to externally sourced content uploaded by you. Records of courses completed through CE Solutions are retained separately in accordance with our accreditation and regulatory obligations.
15. Course Access, Categorization, and Pricing
CE Solutions reserves the right to modify, correct, or adjust these Terms, including but not limited to the duration of course access, in the event of system errors, glitches, or technical issues. If a user purchases a course with access terms that are inconsistent with current offerings, or that result from a system error, CE Solutions will make reasonable efforts to resolve the situation fairly, which may include providing the correct course access terms.
CE Solutions reserves the right to reassign, reclassify, or recategorize courses and course packages at any time to better align with updated offerings, accreditation requirements, or platform organization. Categories are often interchangeable across multiple certification types, and this flexibility helps ensure the broadest possible credit recognition. As a result, completed or in-progress courses may appear under different categories in your course history. Once continuing education credit is earned and recorded, it will not be lost, regardless of any future changes to category labels or course groupings.
CE Solutions is not responsible for any incorrect course selections related to your continuing education. As a professional, you are solely responsible for choosing appropriate programs and courses. Any errors in course selection are your responsibility, and credit will not be granted for mistakes made on your part.
To maintain compliance with accreditation standards and regulatory requirements, CE Solutions reserves the right to limit course access strictly to the certification level currently held by the participant. Students are responsible for enrolling only in programs appropriate to their active provider status.
CE Solutions reserves the right to modify pricing for courses and services without prior notice, based on various factors, including but not limited to certification level. The pricing displayed on the checkout page is the most accurate and up-to-date pricing and may differ from the pricing shown on our main pricing page due to dynamic pricing adjustments. While we strive to keep our pricing page accurate, it is not always fully reflective of the final cost. Users agree to the final pricing at checkout, which is determined based on their selected course or certification level.
16. Exam Scoring
CE Solutions will not alter or adjust passing exam scores due to perceived question inaccuracies, scoring issues, or system errors, unless a material and verifiable error is confirmed by our education review team and that error directly affected the passing outcome.
17. System Errors and Cooperation
By using this site and completing a purchase, the user acknowledges that discrepancies due to unforeseen system errors may occur, and agrees to cooperate in resolving any such issues. CE Solutions will take reasonable steps to ensure that users are treated fairly and that any necessary corrections are made. However, CE Solutions will not be held liable for any inconvenience or loss caused by technical errors or system issues.
18. Online CEU Regulations and Course Timers
Online CEU regulations mandate that participants spend a verifiable minimum amount of time on each course before taking the exam, similar to in-person classes. This requires students to remain on screen for the entire course duration. The era of downloading the material, or allowing the timer to run out and returning later to take the test, is over.
To comply with these requirements, all online CE providers, including CE Solutions, must implement timers and pop-ups within each course to verify attendance. Regulations strictly prohibit altering this function. Regulations also prohibit users from running the course countdown timer by opening multiple browsers or multiple courses simultaneously.
To ensure that users fully engage with the course content for which they are earning credit, you must remain active on the course page without opening other browsers or tabs. If you navigate away, the timer will stop. Avoid letting your device enter sleep mode, and promptly answer the questions that appear on screen. Failure to do so will cause the timer to pause. If multiple courses are opened, or if you navigate away from the course page, the timer stops on all open courses and resumes only when you remain on a single course for the designated time.
These regulations are set by your state and the NREMT and are a requirement for every CE provider.
Students are advised to take the exam immediately upon completion of the course material. Courses are frequently culled, updated, and removed without notice. If you choose not to take the exam immediately upon completing the course, you assume the risk of lost time spent on that course. There is no way to retrieve time spent on a course after it has been updated, culled, or removed.
19. Attendance Verification and Prohibited Conduct
By enrolling and participating in the CE Solutions program, students agree to comply with our attendance verification policy, which is required to meet state and accreditation standards.
Students must complete the full duration of each course to receive Continuing Education Units (CEUs), as the number of hours attended must match the CEUs awarded. Partial attendance may result in denial of credit.
CE Solutions uses advanced tracking methods, including time stamps, IP address logging, and electronic participation records, to verify attendance. These records may be audited by regulatory agencies.
Any attempt to manipulate or bypass this system, including but not limited to using software to simulate activity, logging in under another person's account, or leaving sessions unattended, is strictly prohibited. Violations may result in loss of CEU credit, notification to licensing bodies, and potential disciplinary action, up to and including loss of license or certification. CE Solutions will cooperate fully with audits, and students are solely responsible for any consequences resulting from noncompliance.
By participating in any CE Solutions educational offering, students acknowledge and accept these Terms in their entirety.
20. Interpretation and Entire Agreement
The language in these Terms shall be interpreted according to its fair meaning and not strictly against CE Solutions. These Terms may only be amended in writing by a duly authorized partner of CE Solutions, with specific reference to these Terms.
These Terms constitute the entire and only agreement between CE Solutions and any viewer or user of this site, and supersede any and all prior or contemporaneous agreements, representations, warranties, and understandings with respect to this site and the information contained on it.
